Article 4 Posting and Amendment of These Terms
- The Company posts these Terms in the Service so that Members can view them at any time.
- The Company may amend these Terms to the extent that this does not violate applicable laws, including the Act on the Regulation of Terms and Conditions and the Act on the Consumer Protection in Electronic Commerce.
- When the Company amends these Terms, it will announce the effective date, the changes and the reasons in the Service at least 7 days before the effective date. If a change is unfavourable to Members, the Company will announce it at least 30 days before the effective date and will also notify each Member individually, for example by e-mail or in-app notification.
- When a major version of these Terms changes (for example, from 1.x to 2.0), the Company will ask Members to consent again. A Member who does not consent cannot continue to use the Service after the effective date of the amended Terms and may delete their account.
- For changes other than a major version change, if the Company, when announcing or notifying the change under paragraph 3, clearly stated that a Member who does not object by the effective date will be deemed to have accepted it, and the Member does not object, the Member is deemed to have accepted the amended Terms. A Member who does not accept may delete their account.
Article 5 Formation of the Service Agreement
- The service agreement is formed when a person who wishes to use the Service signs in with a Google or Apple account and agrees to the required consent items on the sign-up screen.
- The required consent items at sign-up are:
- I am 14 years of age or older (residents of the European Economic Area (EEA) must be at or above the age of digital consent set by their country, which is between 13 and 16);
- Consent to the Terms of Service;
- Consent to the collection and use of personal information;
- Consent to AI photo analysis;
- Consent to the overseas transfer of personal information.
- Consent to receive news and offers by e-mail or push notification is optional. Members can use the Service without giving it.
- Consent to showing photo location is requested separately when the Member first turns on location display for a photo.
- Persons under 14 (or, for EEA residents, under the age of consent in their country) cannot sign up for the Service. If the Company learns that a Member falls into this category, it may terminate the service agreement.
Article 6 Account
- Members sign in to the Service with a Google account (iOS and Android) or an Apple account (iOS). The Company does not receive or store a Member's Google or Apple password.
- Members are responsible for keeping their devices and the Google or Apple account they use to sign in secure. The Company is not liable for damage caused by a third party using an account because of the Member's failure to keep it secure, unless the Company is at fault.
- If a Member becomes aware that their account has been stolen or is being used without permission, they must notify support@photoz.co.kr immediately.
- Members may not use another person's account or transfer or lend their account to another person.
Article 7 Protection of Personal Information
The Company protects Members' personal information in accordance with applicable laws. The processing of personal information is governed by the separate "Photoz Privacy Policy" and "Photoz AI Notice".
Article 8 Obligations of the Company
- The Company complies with applicable laws and these Terms and makes efforts to provide the Service stably.
- The Company does not make Originals available to anyone other than the Member who uploaded them, and maintains technical measures to protect Originals.
- If the Company finds a Member's opinion or complaint justified, it will deal with it and inform the Member of the outcome by e-mail or other means.
Article 9 Obligations of Members and Prohibited Acts
- Members must comply with applicable laws, these Terms and the guidance provided in the Service.
- Members must not:
- upload, as their own work, photos they did not take or have no rights to;
- attempt to evade the Capture Verdict, for example by forging or altering metadata in order to make a generative-AI image, digital artwork or screenshot public as a captured photo;
- upload child sexual abuse material, sexually explicit images, or gory or gruesome images;
- infringe the rights of others, including copyright, portrait rights and privacy;
- harass other users or post Content that insults, defames, discriminates against or promotes hatred of others;
- circumvent or disable the Company's content protection measures, such as screenshot blocking, watermarks and signed URLs, or collect, copy or distribute other users' photos without permission;
- access the Service by automated means (such as bots or scrapers) or interfere with the normal operation of the Service;
- impersonate another person or use another person's account;
- transmit malicious code or gain unauthorised access to the Company's systems;
- use the Service for commercial advertising or promotion without the Company's prior consent;
- do anything else that violates applicable laws.
Article 10 Content Policy: Photos You Took Yourself
- Members may upload only photos they took themselves or photos they have the right to upload.
- By uploading a photo, the Member warrants that they took the photo themselves or own the rights to it, and that the photo does not infringe the rights of any third party.
- If a Member breaches this warranty and the Company or a third party suffers damage as a result, the Member is liable for that damage, unless the Member is not at fault.
Article 11 Capture Verdict and Restrictions on Publishing
- Every uploaded photo is first stored in the Private Archive.
- The Company's server makes the Capture Verdict based on the photo's metadata (EXIF, XMP, C2PA) and AI analysis. Any preliminary result the app shows before upload is for reference only; the server makes the final verdict.
- Only photos whose Capture Verdict is camera capture (camera) or scanner scan (scanner) can be made public.
- Photos judged to be generative-AI images, digital artwork or screenshots may be uploaded but cannot be made public. They stay in the Private Archive, where only the Member can see them.
- If there is not enough evidence to decide (unknown), the photo stays private and the Company tells the Member the result and the reason.
- The Capture Verdict is made by automated means and may be wrong. Members may ask for an explanation of a verdict, object to it and request human review. How to do so is set out in the "Photoz AI Notice" and the "Photoz Privacy Policy".
Article 12 Upload Safety Check and Prohibited Content
- The Company runs a safety check on every uploaded photo. Photos identified as child sexual abuse material, sexually explicit images or gore are refused and are not posted in the Service.
- Refused photos cannot be used in the Service. However, to meet its legal obligations, the Company may keep such a photo as evidence, encrypted and in storage separate from its general storage, for the period required by law.
- The Company may report to, or provide material to, the relevant authorities as required by law.
- The Company may restrict the use of a Member who uploads prohibited content in accordance with Article 22.
- Photos that cannot be assessed automatically, for example because the file cannot be read, may remain private and undergo human review.
Article 13 AI Features
- The Company uses AI for the safety check, to support the Capture Verdict, and to suggest titles, descriptions, tags and categories. Details are set out in the "Photoz AI Notice".
- Titles, descriptions, tags and other items created by AI are only suggestions. They do not become the Member's Content until the Member edits or approves them. Members are responsible for checking and editing suggestions before publishing.
Article 14 Copyright and Licence
- Copyright in the photos and Content a Member uploads remains with the Member (the author). The Company does not acquire the Member's copyright.
- The Member grants the Company a non-exclusive, royalty-free right, limited to what is necessary to operate the Service, to store photos and Content, to create Derivatives (resizing and watermarking), and to display them within the Service.
- The Company does not use a Member's photos beyond the scope of paragraph 2 and does not use them to train AI models.
- The licence in paragraph 2 ends when the Member deletes the photo or deletes their account, except where retention is required under Article 12(2) or applicable laws.
- Rights in the Service itself (the apps, design, trademarks, logos, software and so on) belong to the Company.
Article 15 Protection of Originals and Downloads
- Only the Member who uploaded an Original can download that Original, through a signed URL that is valid for a short time. No other user ever receives Originals or downloads of them. Members should still keep their own copies of their original files.
- The Service gives other users only watermarked Derivatives, through signed URLs that are valid for a short time.
- The apps block screenshots and screen recording on screens that show photos. However, because of the characteristics of devices and operating systems, it is not possible to prevent all copying completely.
Article 16 Reporting Infringement
- Anyone who believes their photo has been stolen or that Content in the Service infringes their rights may report it by sending the link to the Content and material showing that they are the rights holder (such as the original file or capture information) to support@photoz.co.kr.
- On receiving a report, the Company may hide the photo while it reviews the report, and will notify the uploading Member and give them an opportunity to respond.
- If the review finds an infringement, the Company will remove the photo and may suspend Members who repeatedly infringe.
- The procedure in this Article does not limit the procedures set out in applicable laws, including the Copyright Act.
Article 17 Photo Location
- GPS location information contained in a photo is not shown publicly by default.
- Location is shown to other users only if the Member turns on location display for that photo and chooses a precision (exact, neighbourhood or city), and then only at the chosen precision.
- Members may turn off location display or change its precision at any time.
Article 18 Author Grade
- The Company regularly recalculates each Member's Author Grade (Standard, Bronze, Silver, Gold, Platinum, Diamond) based on the ratings the Member receives.
- The Author Grade indicates activity within the Service and has no monetary value and confers no legal rights.
Article 19 Changes to and Suspension of the Service
- The Company may change all or part of the Service for operational or technical reasons. Significant changes that are unfavourable to Members will be announced in the Service at least 7 days in advance (30 days if the change affects paid services).
- The Company may temporarily suspend the Service for unavoidable reasons such as maintenance, replacement or failure of equipment, communication failures or natural disasters. The Company will announce this in advance or, where that is not possible, afterwards.
- If the Company ends the Service because it is closing the business, it will announce this in the Service and notify Members individually at least 30 days before the end date.
Article 20 Subscription Plans and Payment
-
The Service offers the following Subscription Plans.
Plan Monthly upload limit Photos per upload batch Free Unlimited 10 Pro Unlimited 30 -
The price, billing period and other specific terms of the Pro plan are shown in the app and on the App Store or Google Play purchase screen before purchase.
-
The Pro plan is paid for as an in-app subscription through the App Store or Google Play, and payment is processed under each store's payment system and terms. The Company does not receive Members' card details or other payment method information.
-
Subscriptions renew automatically in the manner set by each store unless the Member cancels. Members can cancel in each store's subscription management screen. Deleting the app or deleting the Photoz account alone may not cancel the store subscription.
-
If the Company changes the content or price of a plan, it will give advance notice in accordance with Articles 4 and 19.
Article 21 Withdrawal and Refunds
- Refunds are requested from the App Store or Google Play, whichever processed the payment, under that store's refund policy.
- Notwithstanding paragraph 1, rights guaranteed to Members by applicable laws, such as the right of withdrawal under the Act on the Consumer Protection in Electronic Commerce, are not limited. Members who need help with a refund may contact support@photoz.co.kr.
- If a Member cannot use a paid service for reasons attributable to the Company, the Company will take the necessary measures in accordance with applicable laws and each store's policy.
Article 22 Restrictions on Use
- If a Member violates Article 9 or uploads prohibited content, the Company may, considering the nature, severity and repetition of the violation, issue a warning, hide or remove Content, restrict uploads, or suspend the account temporarily or permanently.
- For serious violations, such as uploading child sexual abuse material, the Company may suspend the account immediately without prior warning.
- When the Company restricts use, it will inform the Member of the reason and the duration. The Member may object by e-mail to support@photoz.co.kr, and if the objection is found justified, the Company will lift the restriction immediately.
Article 23 Account Deletion and Termination
- Members may delete their account at any time in the app under Profile → Delete account, after signing in again to confirm their identity.
- Deletion immediately and irreversibly removes the following: photos and Originals, profile, tags, follows, likes and saves, and all sign-in sessions. If the Member signed in with Apple, the Company revokes the Apple sign-in tokens.
- Notwithstanding paragraph 2, records that applicable laws require to be kept, pseudonymised consent records and legally required safety-check evidence are kept for the periods set out in the "Photoz Privacy Policy" and then destroyed.
- The Company may terminate the service agreement if a Member falls under a ground for permanent suspension under Article 22, in which case it will inform the Member of the reason.
Article 24 Damages and Limitation of Liability
- If the Company or a Member violates these Terms and causes damage to the other, it is liable for that damage, unless it is not at fault.
- The Company is not liable when it cannot provide the Service because of force majeure beyond its control, such as natural disasters, war, power failures or interruption of service by telecommunications carriers.
- The Company is not liable for disruption to the use of the Service caused by reasons attributable to the Member.
- The Company is not responsible for the accuracy, reliability or lawfulness of Content posted by Members, and has no obligation to intervene in disputes arising through the Service between Members or between a Member and a third party, unless the Company is at fault.
- This Article applies to the extent permitted by applicable laws, including the Act on the Regulation of Terms and Conditions and the Act on the Consumer Protection in Electronic Commerce, and does not exclude the Company's liability for wilful misconduct or gross negligence.
Article 25 Governing Law and Jurisdiction
- These Terms and any dispute about the use of the Service are governed by the laws of the Republic of Korea. This does not affect the protection that the mandatory laws of the Member's country of residence give consumers.
- Lawsuits about disputes between the Company and a Member are to be filed with the court having jurisdiction under the Civil Procedure Act of the Republic of Korea.
Article 26 Language
These Terms are provided in Korean, English, Japanese, Chinese (Simplified), Spanish, Portuguese, French and German. If the language versions conflict, the Korean version prevails.
