This notice explains how Keyfred Inc. (the "Company") uses AI in "Photoz" (the "Service"), its photo archive and community service, what information is sent to whom, and what rights Members have. It applies together with the "Photoz Terms of Service" and the "Photoz Privacy Policy".

Article 1 What AI Does

The Company uses AI for the following five purposes. Items 1 to 3 apply to every uploaded photo.

  1. Safety check: classifying whether a photo is child sexual abuse material, a sexually explicit image or gore. Photos in these categories are refused.
  2. Capture verdict support: helping decide whether a photo was captured by a camera or scanner, or is a generative-AI image, digital artwork or screenshot. The server makes the verdict based on both a check of the metadata (EXIF, XMP, C2PA) and AI analysis.
  3. Metadata suggestions: suggesting a title, description, tags and a category for the photo, in the device language and in English.
  4. Comment translation: at a Member's request, translating another Member's comment into the Member's language.
  5. Welcome messages for new photographers: when a Member publishes a photo for the first time, the official Photoz account sends them a welcome as a direct message. The message is written by AI in the Member's language from that photo and its title, description and tags, and is sent automatically without prior human review.

Article 2 What Is Sent and to Whom

  1. For AI analysis and comment translation, the Company sends the following first to the OpenAI API provided by OpenAI, L.L.C. (USA), and only when the request could not be processed with the OpenAI API, to the Gemini API provided by Google LLC (USA):
    • for each uploaded photo, a copy downscaled to 768px on the long side with metadata removed;
    • an EXIF summary (camera make and model, lens, focal length, aperture, shutter speed, ISO, capture time);
    • for photos with location, the city name derived from the GPS coordinates may be sent instead of the coordinates;
    • the content of comments a Member has asked to translate.
    • for the welcome message: the title, description and tags of the Member's first published photo, shortened if long (together with the downscaled copy and EXIF summary above); no name or other account information is sent.
  2. Original files and account information such as name and e-mail address are not sent for AI analysis or comment translation.
  3. Data is sent encrypted over the network at the time the uploaded photo is processed and at the time a Member asks to translate a comment. The data needed for the welcome message is sent in the same way when the message is written after a Member first publishes a photo.
  4. Details of the overseas transfer (country, items, purpose, period, method) are set out in Article 6 of the "Photoz Privacy Policy".

Article 3 No Use for AI Training

  1. The Company does not use Members' photos or comments to train AI models.
  2. The Company uses the OpenAI API and the paid tier of the Gemini API, and under the OpenAI API terms and the Gemini paid-tier terms, neither OpenAI nor Google uses Members' photos or comments to train its models.
  3. However, under their terms OpenAI and Google may retain inputs for abuse monitoring: OpenAI for up to 30 days and Google for a limited period. The Company sends requests to OpenAI with response storage turned off.

Article 4 AI Suggestions Are Only Suggestions

  1. Titles, descriptions, tags and categories created by AI are suggestions. They do not become the Member's Content until the Member edits or approves them.
  2. Members can use suggestions as they are, edit them or delete them. A photo can be made public without accepting any suggestion.
  3. AI suggestions may be inaccurate or inappropriate. Please check them before publishing.
  4. Equipment tags such as camera and lens are created from the photo's EXIF information, not by AI.

Article 5 Automated Publishing Decisions and Their Limits

  1. Every uploaded photo is first stored as private.
  2. Based on metadata and AI analysis, the server classifies each photo as one of: camera capture (camera), scanner scan (scanner), generative-AI image (generated), digital artwork (digital_art), screenshot (screenshot) or undetermined (unknown).
  3. Only photos classified as camera capture or scanner scan can be made public. Other photos are kept in the Private Archive, where only the Member can see them.
  4. If the evidence is insufficient (unknown), the photo stays private and the Company tells the Member the result and the reason. For example, if metadata is lost during editing or format conversion, even a captured photo may be classified as unknown.
  5. This decision is made automatically, without human involvement. Automated decisions have limits: a photo that was actually captured may be judged unable to go public (a false positive), and the reverse can also happen. Because metadata can be forged, the Company supplements the decision with reports from Members and human review.
  6. The safety check is also automated, and photos identified as prohibited content are refused. To meet its legal obligations, the Company may keep a refused photo as evidence, encrypted and in separate storage, for the period required by law.
  7. Any preliminary result the app shows before upload is for reference only; the server makes the final verdict.

Article 6 Requesting an Explanation and Human Review

  1. Under Article 37-2 of the Korean Personal Information Protection Act and Article 22 of the EU General Data Protection Regulation (GDPR), Members may request the following regarding an automated decision:
    • an explanation of the result and its main reasons;
    • to object to (contest) the decision;
    • human review.
  2. How to request: send the photo concerned (the photo details shown in the app) and your request to support@photoz.co.kr. Including material that shows the photo was captured (for example, capture information from a file taken directly from the camera) helps the review.
  3. The Company will respond within the period set by applicable laws. If human review finds that the decision was wrong, the Company will correct it.

Article 7 Consent and Refusal

  1. AI photo analysis, and the overseas transfer it requires, are required consent items at sign-up.
  2. Because AI analysis is essential for the safety check and the capture verdict, a person who does not consent cannot upload photos and cannot use the Service.
  3. Members may withdraw consent at any time. Because the Service cannot continue to be provided without the required consents, withdrawal is handled as an account deletion, which can be done in the app under Profile → Delete account. Withdrawal does not affect processing carried out before it.

Article 8 Language

This notice is provided in Korean, English, Japanese, Chinese (Simplified), Spanish, Portuguese, French and German. If the language versions conflict, the Korean version prevails.
